PEGNL's New Act
The following memorandum will be sent to all PEGNL members by Canada Post in the next few days; however, because it addresses a very important topic, I am including the text of the memo as my message for this edition of Dialogue.
SUBJECT: Engineers and Geoscientists Act 2008
As regularly reported to PEGNL Members, Council has been working with the Government of Newfoundland and Labrador on planned changes to our Act for a number of years.
In 2008, work on drafting revisions to the 1989 Act accelerated, with regular discussions being held between government representatives and Council's Legislative Task Force.
In December 2008, PEGNL Council signed off on the final draft of a new Act and the House of Assembly approved the legislation. On December 18, 2008, the new Act was given Royal Assent. While the 2008 Engineers and Geoscientists Act will create significant changes to PEGNL's governance and regulatory process, Council is satisfied that the new conditions are in the best interest of the public and PEGNL.
I should remind members that the initiative to legislate a new Engineers and Geoscientists Act came from Government and has resulted in similar changes to most other self-regulating occupations. The primary reason cited for this action was the standardization of disciplinary processes used by all self-regulating professions in this Province. While there was flexibility shown by government on some matters, government was not prepared to alter the language of other sections of the Act.

The new Act will come into effect on July 1, 2009 and work is now underway to write Regulations to support implementation of the Act. PEGNL will draft the regulations for review and approval of the Minister of Government Services.
The 2008 Act provides for the orderly transition from the 1989 Act. The provisions have two important implications. First, discipline cases initiated before July 1, 2009 can be addressed using the current discipline process. Second, professional members of Council whose term of election would have continued beyond June 30, 2009 will be permitted to serve on the new Board of Directors until the expiration of their respective terms. As a result, 9 current members of Council may continue. Should they all choose to do so, there will be no requirement for a Council election in 2009.
For most Members, the transition of PEGNL operations from the current system to one under the new Act will have no obvious implications.
